sir who will appoint liquidator in liquidation proceedings coc under regu. 3A or adjudicating authority under section 34?
The Adjudicating Authority (NCLT) appoints the liquidator under Section 34 of the IBC, but the Committee of Creditors (CoC) plays a vital role in recommending/proposing the name under Regulation 3A of the IBBI (Liquidation Process) Regulations.
