Section 30 (2 ) (ba) of ibc

Hi sir. I sec 30 (2 ) (ba) is the ammended part for financial creditor who didn't voted in favour of resolution plan. In this , the clause (ba) quotes : fc who didn't vote in favour of the RP should be paid " which shall not be less than the lower of the amount " . Sir i am unable to interpret that. I would mean ki jo 2 amount ayege unme se jo lowest rhega utna to dena hi hai??

Yes, your interpretation is 100% correct! Section 30(2)(ba) sets a statutory minimum floor for dissenting financial creditors (those who voted against or abstained from voting in favor of the Resolution Plan). The clause specifies that a dissenting financial creditor must be paid at least (minimum) the lower of two calculated amounts. In simple terms, you calculate both values, pick whichever is smaller, and the Resolution Plan must guarantee at least that amount to the dissenting financial creditor.
